What has changed for people who already obtained a residence permit based on real estate

01

The residence permit is not cancelled automatically

The change in the law does not by itself terminate a residence permit previously issued on the basis of real estate. The permit's expiry date and the rules for the next application must still be considered.

02

Transitional rules apply

Transitional rules are provided for people who obtained a residence permit based on real estate before the change. In the cases set out by law, they allow the application process to continue on the previous basis.

03

A subsequent residence permit is not issued automatically

Before applying, you need to confirm that the previous basis remains valid and that the transitional requirements are met. The application must be submitted before the current residence permit expires.

04

A new property purchase cannot secure a new residence permit

From 15 September 2026, a new real estate purchase is no longer a basis for obtaining a new residence permit in Latvia.

How NBC.LV helps with residence permits based on real estate

  1. 1
We determine whether the previous basis can be retained

We review your circumstances and previously issued residence permit to establish whether the transitional rules apply to you.

  2. 2
    We prepare the documents

We draw up a document checklist for your case, help prepare any missing items and assemble the application package.

  3. 3
We identify another basis if necessary

If the previous basis cannot be retained or another option would suit you better, we assess employment, business, family reunification, investment in company capital and other possible grounds.

  4. 4
We prepare documents for family members

If your spouse and minor children are applying with you, we review their circumstances and prepare documents for the whole family. The requirements for each family member are assessed separately.

  5. 5
We support the residence permit procedure

We assist with the submission, respond to additional requests from OCMA and remain available until the review is completed.

What to know before your next residence permit application

If you obtained a residence permit based on real estate before the law changed, the transitional rules may allow you to apply again on the same basis. You need to do so while your current residence permit is still valid.

For the next application, you must show that the relevant conditions continue to be met. Under the transitional rules, a repeat residence permit may be issued for up to 5 years.

The conditions for repeat applications are set out in the transitional provisions of Latvia's Immigration Law. The end of the previous basis for new purchasers is also confirmed by official OCMA information.

Information updated in October 2026.

Important: these rules apply only to residence permits previously obtained on the basis of real estate. From 15 September 2026, a new property purchase is no longer a basis for obtaining a new residence permit.

Frequently asked questions

Can I obtain a residence permit in Latvia by purchasing real estate in 2026?

No. From 15 September 2026, purchasing real estate is no longer a basis for obtaining a new residence permit in Latvia. The transitional rules apply to people who obtained a residence permit based on real estate before the change.

How do I reapply for a residence permit based on real estate in 2026?

First, you need to confirm that the transitional rules apply to you. The application for a repeat residence permit must be submitted while your previous permit is still valid. NBC.LV can assess your circumstances, prepare the documents and support the application process.

Can a residence permit based on real estate be obtained again?

Yes, provided the permit was previously issued on this basis, the application is submitted within the required period and your circumstances meet the transitional rules. This is a further application based on a previously issued permit, not a new permit obtained through a new purchase.

How long can a repeat residence permit based on real estate be issued for?

Up to 5 years. This period is provided by the transitional rules if the relevant conditions are met.

Do I need to retain the property for a repeat residence permit?

Yes. If you continue on the previous basis, the investment must be retained and the related requirements must be met. NBC.LV can identify the conditions and documents relevant to your case.

What happens to the residence permits of my spouse and children?

Their circumstances must also be reviewed. The requirements and documents for each family member are assessed separately, particularly if a child has reached adulthood or the family's circumstances have changed.

What should I do if I cannot continue with a residence permit based on real estate?

You can consider another basis, such as employment, business, family reunification, investment in company capital or another suitable option. NBC.LV can assess the possible grounds and prepare the documents for the transition.
